1.About Cheecle Photo

Cheecle Photo (“Cheecle,” “we,” “our,” or “us”) is an online photo printing service that has been operating since 2009. We offer premium photo printing, color correction, trimming, and related products delivered to customers in the United States and Canada. Our website is located at wp.cheecle.com.

2.Acceptance of Terms

By visiting our website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms of Use and any policies referenced herein (including our Privacy Policy and Refund Policy). These Terms constitute a legally binding agreement between you and Cheecle Photo.

If you are using our services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3.Eligibility

You must be at least 18 years of age (or the age of majority in your province or state) to use our services. By using our site, you represent and warrant that you meet this requirement. We do not knowingly collect information from or market to minors.

4.Account Registration

Some features of our service require account registration. You agree to:

• Provide accurate, current, and complete information during registration;
• Keep your login credentials confidential and not share your password with any third party;
• Notify us immediately of any unauthorized use of your account;
• Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5.Orders, Payment & Pricing

Placing Orders: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including if pricing errors or stock issues arise.

Pricing & Taxes: All prices are displayed in Canadian Dollars (CAD) or US Dollars (USD) as indicated. Applicable federal and provincial/state taxes will be added at checkout in accordance with the laws of your jurisdiction.

Payment: We accept major credit cards and other payment methods as displayed at checkout. Payment is processed securely. By submitting your order, you authorize us to charge the applicable payment method.

Order Confirmation: You will receive an email confirmation once your order is accepted. This does not guarantee product availability and we reserve the right to contact you if any issue arises.

6.Photo Uploads & Content Policy

When you upload photos to our platform, you represent and warrant that:

• You own the photos or have obtained all necessary rights, licenses, and permissions to use and reproduce them;
• The photos do not infringe any copyright, trademark, privacy, or other intellectual property rights of any third party;
• The photos do not contain illegal, obscene, defamatory, or otherwise objectionable content;
• You have obtained consent from any identifiable individuals in the photos where required by applicable law.

Content We Process: Uploaded photos are used solely for the purpose of fulfilling your order. We may use AI-assisted tools to enhance image quality (color correction, cropping optimization). By uploading, you grant Cheecle a limited, non-exclusive license to process your photos for order fulfillment purposes only.

Prohibited Content: We strictly prohibit the printing of content that is illegal, pornographic, depicts minors in any inappropriate manner, promotes hate or violence, or infringes third-party rights. We reserve the right to refuse any order containing such content without refund.

Photo Retention: Uploaded photos are retained on our servers for a limited period to facilitate order processing and potential reprints. Please refer to our Privacy Policy for details on data retention.

7.Intellectual Property

All content on the Cheecle Photo website — including logos, graphics, text, software, and design elements — is the exclusive property of Cheecle Photo or its licensors and is protected by copyright, trademark, and other intellectual property laws of Canada and the United States.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our website without our express written permission.

Your Photos: You retain full ownership of the photos you upload. We claim no ownership rights over your images.

8.Shipping & Delivery

We ship to addresses within Canada and the United States. Estimated delivery times are provided at checkout and are not guaranteed. Cheecle Photo is not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control.

• Shipping costs and methods are displayed at checkout;
• Risk of loss passes to you upon delivery to the carrier;
• For international shipments between Canada and the US, customs duties and import fees (if any) are the responsibility of the recipient;
• Please ensure your shipping address is accurate — we are not responsible for orders delivered to an incorrect address provided by the customer.

9.Returns, Refunds & Cancellations

Because photo prints are custom-made to order, we generally do not accept returns. However, we stand behind our quality and will offer a reprint or refund if:

• The product arrives damaged or defective;
• The print quality significantly differs from what was ordered due to our error;
• The wrong item was shipped.

Cancellations: Orders can be cancelled only before they enter production. Once printing has begun, cancellations are not possible. Please contact us as soon as possible if you need to cancel.

How to Request: Contact us within 7 days of receiving your order with photos of the issue and your order number. We will evaluate and respond within 3 business days.

10.Disclaimer of Warranties

Our services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Cheecle Photo disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. The quality of AI-assisted color corrections is provided as a best-effort enhancement and does not guarantee specific results.

11.Limitation of Liability

To the maximum extent permitted by law, Cheecle Photo and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, our services — including but not limited to loss of profits, data, goodwill, or other intangible losses.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid for the specific order giving rise to the claim.

12.Privacy & Personal Information

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the practices described in our Privacy Policy.

We comply with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada and applicable US state privacy regulations where required.

13.Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws applicable to your location:

• Canadian customers: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts of Ontario for any dispute arising under these Terms.
• US customers: These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Delaware for any dispute arising under these Terms.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

14.Dispute Resolution

We encourage you to contact us first to resolve any concerns before pursuing formal legal action. Most issues can be resolved quickly and informally.

Informal Resolution: Contact us at the email below with a description of your dispute. We will attempt to resolve it within 30 days.

Arbitration (US customers): If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Canadian customers retain the right to pursue claims through applicable provincial small claims courts or consumer protection agencies.

15.Changes to These Terms

Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
